Cooper Automotive 30th Birthday Competition – Terms and Conditions

These Terms and Conditions (“T&Cs”) govern the Cooper Automotive 30th Birthday Competition (“Competition”) promoted by Cooper Automotive Pty Ltd (ABN: 66 097 157 143) of 55 Federal Street, North Hobart, Tasmania 7000 (“Promoter”). By entering the Competition, each entrant agrees to be bound by these T&Cs. Entry into the Competition is deemed acceptance of these T&Cs. The Promoter reserves the right to amend, suspend, or terminate the Competition at any time, subject to applicable laws. No permit is required under Tasmanian law for this trade promotion, provided all conditions are met.

  1. Eligibility
  • Entry is open to Australian residents aged 18 years or older who are Tasmanian residents or have access to one of the Promoter’s service locations (Hobart, Launceston, Lindisfarne, Moonah, Mornington, North Hobart).
  • Entry is open to retail customers only. Fleet customers are not eligible to enter.
  • Employees, officers, and immediate family members (spouse, de facto spouse, parent, child, sibling, whether natural or by adoption) of the Promoter, its related entities, or agencies associated with the Competition are ineligible to enter.
  • Entrants must provide accurate personal information (e.g., name, phone number, email) during entry. Incomplete, illegible, or fraudulent entries will be disqualified.
  • The Promoter reserves the right to verify eligibility and disqualify entrants who tamper with the entry process or submit multiple entries from the same person/device unless permitted.
  1. Promotion Period
  • The Competition commences at 9:00 AM AEST on 11 September 2025 and closes at 5:00 PM AEST on 28 November 2025 (“Promotion Period”).
  • Entries received outside this period are invalid.
  1. How to Enter
  • To enter, participants must spend a minimum of $100 at any of the Promoter’s 6 locations (Hobart, Launceston, Lindisfarne, Moonah, Mornington, North Hobart) during the Promotion Period to receive one entry into the draw. For each additional $100 spent the participant will receive one (1) additional entry (e.g., $199 spent = 1 entry and $200 spent = 2 entries).
  • Services must be paid in full at the time of completion. Entries are not transferable and cannot be purchased separately.
  • Maximum entries: Unlimited, subject to the number of services booked and completed.
  • No purchase is necessary to enter, but entry is conditional on completing a service (in compliance with Australian trade promotion laws allowing purchase-based entries at market price).
  • Entries via automated, scripted, or third-party services are prohibited and will be disqualified.
  1. Prize Details
  • Prize: One (1) winner will receive a 10-night South Pacific Cruise for four (4) people on Carnival Encounter, valued at up to $4,800 (including GST). The cruise departs from Brisbane on 21 April 2026 and includes visits to destinations such as Vanuatu and New Caledonia.
  • Prize inclusions: Cabin accommodation, onboard meals, and standard entertainment as per Carnival Encounter’s itinerary. Exact itinerary subject to availability and Carnival’s terms.
  • Prize exclusions: Flights to/from Tasmania or Brisbane; travel insurance; visas; additional onboard expenses (e.g., drinks, excursions, gratuities); transfers; or any other costs associated with travel to the departure port. The winner is responsible for all such expenses.
  • The prize is non-transferable, non-exchangeable, and not redeemable for cash. The Promoter takes no responsibility for variations in prize value due to supplier changes.
  • The prize must be taken on the specified departure date; no changes permitted. All travel must comply with health, safety, and government requirements at the time of travel.
  • Total prize pool value: $4,800 (including GST). Prizes are subject to availability.
  1. Draw and Winner Selection
  • This is a game of chance; winners are selected randomly.
  • The draw will take place at 10:00 AM AEST on 1 December 2025 at Cooper Automotive, 55 Federal Street, North Hobart, Tasmania 7000.
  • The first valid entry drawn will win the prize.
  • The draw will be conducted by an independent representative of the Promoter. Results are final, and no correspondence will be entered into.
  • In the event of non-compliance with these T&Cs, the prize will be redrawn at the same location and time as the original draw (up to three (3) months later, or as required by law).
  1. Notification of Winners
  • The winner will be notified by phone within two (2) business days of the draw using the contact details provided during entry (Phone: 13 55 55).
  • If the winner cannot be contacted within five (5) business days or does not respond satisfactorily, the prize will be forfeited, and a redraw will occur.
  • Winner details (name and state/territory) will be published on the Promoter’s website (https://cooperautomotive.com.au/30years) and social media channels for at least 28 days after the draw.
  • The winner consents to the Promoter publishing their name, photo, and/or voice for promotional purposes, including a photo of the winner receiving the prize for use on the Promoter’s social media and website (as a condition of accepting the prize).
  1. Prize Claim and Delivery
  • The winner must claim the prize within 28 days of notification by contacting the Promoter.
  • The prize will be arranged and delivered within 60 days of claim confirmation, subject to the winner providing necessary details (e.g., passport information for travel).
  • The winner is responsible for ensuring they meet all requirements for the prize (e.g., valid passports, fitness to travel). The Promoter is not liable for any inability to claim the prize due to such issues.
  • Unclaimed prizes will be redrawn and awarded to the next valid entrant.
  1. Privacy and Data Collection
  • The Promoter collects personal information to administer the Competition and for marketing purposes (e.g., future promotions). Information will not be disclosed to third parties without consent, except as required by law or to prize suppliers (e.g., Carnival Encounter).
  • By entering, entrants consent to the Promoter using their information for the above purposes and receiving promotional communications. Opt-out is available via email: info@cooperautomotive.com.au.

  • This Competition complies with the Australian Privacy Principles under the Privacy Act 1988 (Cth).
  1. Intellectual Property
  • All entries become the property of the Promoter. Entrants grant the Promoter a perpetual, royalty-free license to use, reproduce, and publish any entry content (e.g., photos shared in comments) for promotional purposes.
  • The Promoter owns all intellectual property in the Competition, including promotional materials.
  1. Liability and Disclaimers
  • To the extent permitted by law, the Promoter (including its officers, employees, and agents) excludes all liability for any loss, damage, injury, or disappointment suffered as a result of entering the Competition or accepting the prize, including:
    • Any technical issues, theft, unauthorised access, or interference with the entry process.
    • Any variation in prize value or unavailability of the prize.
    • Tax implications (winners should seek independent financial advice).
  • Nothing excludes liability for death, personal injury, or fraud arising from the Promoter’s negligence. Where liability cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), the Promoter’s liability is limited to resupplying the prize or paying its cost.
  • The Promoter is not responsible for entries lost, delayed, or misdirected due to technical failures or events beyond its control (e.g., force majeure).
  • Entrants indemnify the Promoter against any claims arising from their entry or prize use.
  1. General Conditions
  • The Competition is void where prohibited by law.
  • If the Competition cannot proceed due to circumstances beyond the Promoter’s control, the Promoter may cancel, terminate, or modify it without liability.
  • These T&Cs are governed by the laws of Tasmania. Any disputes will be resolved in Tasmanian courts.
  • The Promoter’s decisions are final and binding. Entrants waive any right to seek judicial review.
  • By entering, entrants confirm they meet eligibility criteria and accept these T&Cs.
